امکان‌سنجی اجرای سیاست قانونی‌سازی مواد مخدر در نظام عدالت کیفری ایران با رویکرد تطبیقی

چکیده

هرچند قانونی‌سازی مواد مخدر اغلب تحت تأثیر دیدگاه «جرم‌انگاری» در حاشیه قرار گرفت، ولی در سال‌های اخیر در سیاست کیفری برخی کشورها، مانند کانادا، اروگوئه و بعضی ایالت‌های امریکا، مادۀ مخدر کانابیس به‌مثابه رویکرد اصلی جایگزین شده است. در نظام عدالت کیفری ایران نیز به‌رغم آنکه همواره بر رویکرد جرم‌انگاری در حل مشکل مواد تأکید شده است، ولی نتایج پژوهش‌ها هیچ‌گاه از اثربخشی آن حمایت نکردند. با توجه به تحولات اخیر، این پرسش طرح می‌شود که آیا در نظام عدالت کیفری ایران نیز امکان اجرای سیاست قانونی‌سازی در مورد کانابیس وجود دارد؟ برای پاسخ به این پرسشِ پژوهش تلاش کردیم تا با اتکا بر تلفیقی از روش تحلیل محتوای کیفی و مطالعۀ تطبیقی جریان‌های مؤثر بر قانونی‌سازی کانابیس در ایالات متحدۀ امریکا، به جمع‌آوری، کدگذاری و تحلیل داده‌ها بپردازیم. یافته‌های پژوهش بیانگر تمرکز بر پزشکی‌سازی حوزۀ کنترل مواد مخدر است تا به واسطۀ تأکید بر درمان مصرف‌کنندگان، به بحران مواد مخدر پایان داده شود. این مقدار توجه، از اهمیت درک پیامدهای منفی این رویکرد می‌کاهد و تغییر الگوی مصرف جامعه و مسئلۀ جرم‌زدایی را نادیده می‌گیرد؛ حال آنکه وجود این موارد امکان طرح سیاست قانونی‌سازی کانابیس را محتمل توصیف می‌کند.

چکیده [English]

Drug legalization has often been marginalized under the influences of Criminalization approach, but in recent years, it has become the main policy of in Canada, Uruguay and some states of US in relation to cannabis. In Iranian criminal justice system, although the criminalization approach has always been emphasized, but the evaluation studies indicate the ineffectiveness of these policies. With regards to these circumstances, it is necessary to ask the question whether it is possible to formulate a legalization policy on cannabis in the Iranian criminal justice system or not? So, we collected, coded and analyzed data using qualitative content analysis method and comparative study of cannabis legalization policy in the United States. The findings of the study indicate a focus on medicalization in controlling drugs, which leads to ignoring its negative consequences including cultural dimension of drugs. Whereas the consumption pattern and decriminalization approach should be considered as important variables in legalization policy for cannabis.
