صلاحیت فراسرزمینی بر اساس دکترین آثار در حقوق بین‌الملل

چکیده

«دکترین آثار» یکی از مبانی توجیهی صلاحیت فراسرزمینی در حوزۀ صلاحیت تقنینی، اجرایی و قضایی است و تحولی در مبانی کلاسیک صلاحیت دولت‎‏ها به‌شمار می‌رود. این دکترین در ابتدا با موضوعات عمدتاً اقتصادی، مانند حقوق رقابت، ظهور بیشتری داشته، اما سپس به دیگر قضایا و موضوعات تجاری، اقتصادی و حتی غیراقتصادی توسعه یافته است. دکترین آثار را به‌طور خلاصه می‎توان این‌گونه تعریف کرد: «توانایی و اختیار دولت در اِعمال صلاحیت نسبت به بیگانگان در خارج از کشور که رفتار آن‌ها آثاری را در قلمرو دولت اِعمال‌کنندۀ صلاحیت، ایجاد می‏کند». در این دکترین به‌جای تمرکز بر محل «وقوع رفتار»، بر محل «آثار و تأثیرگذاری رفتار» به‌عنوان مبنای صلاحیت تأکید می‌شود. به دلیل توجه خاص بر «آثار عمل»، برخی این تئوری را عملاً انشعابی از صلاحیت سرزمینی نامیده‏اند و برخی دیگر نیز آن را در قالب سایر اصول صلاحیتی، مانند صلاحیت واقعی یا جهانی، توجیه نموده‎اند. در مقالۀ حاضر، ابتدا تعریف و سیر تحول تاریخی دکترین آثار ارائه شده، سپس ماهیت، جایگاه، مبانی و شرایط اِعمال صلاحیت فراسرزمینی به استناد دکترین آثار در حقوق بین‎الملل بررسی گردیده است. یافته‎های این تحقیق نشان می‎دهد که اولاً با توجه به تفاوت‎ اساسی دکترین آثار با سایر مبانی صلاحیتی، منطقی آن است که این دکترین با وجود قرابت آن با مبانی صلاحیت سرزمینی عینی و صلاحیت واقعی، به‌عنوان یکی از مبانی جدید و مستقل صلاحیت فراسرزمینی دولت‌ها محسوب شود. دوم اینکه اِعمال صلاحیت به استناد این دکترین، به تحقق اثر و احراز شرایط و مبانی خاصی ازجمله «اساسی»، «مستقیم»، و «قابل پیش‌بینی بودن» اثر و رعایت معیارهای حقوق بین‌الملل وابسته شده است

چکیده [English]

The United States has resorted to the “secondary sanctions” via extraterritorial application of domestic laws, measures and executive orders with extraterritorial effects. In the present research, the US unilateral measures in extraterritorial application of its domestic laws in the light of “Principles and rules of public international law’ “the performance of the States has been analyzed. According to the research findings, the unilateral actions of the US in exercising the extraterritorial jurisdiction of its domestic laws has faced two main criticisms,
First; this country has violated the fundamental principles of the international law and neglected the international obligations through the imposing the domestic laws and by issuing the executive orders with extraterritorial effects.
Second; the US has illegally developed its legal power beyond its geographical and jurisdictional domain via abusing its power of sovereignty as the world police.
