نظریۀ همکاری طرفین دعوا و دادرس در حل و فصل اختلاف

چکیده
نظریۀ همکاری طرفین دعوا و دادرس در حل و فصل اختلافات از مباحث جدید آیین دادرسی مدنی است که در چند سال اخیر از سوی یکی از استادان مطرح شده است. نظریۀ همکاری به معنای اجرای قانون تعریف شده است. به‌عبارت‌دیگر، طرفین و دادرس در حل و فصل اختلاف با یکدیگر مشارکت می‏کنند. اگرچه در برخی از قوانین جدید، نظریۀ یادشده به صورت پراکنده مشاهده می‏شود، اما این نظریه در آیین دادرسی مدنی فراملی مصوب 2004م شالودۀ اصلی را تشکیل می‏دهد و نمود اصلی را دارد. با بررسی قوانین کشور، این نتیجه یافت می‏شود که نظریۀ همکاری، هرچند در پاره‏ای مواد دیده می‏شود، این امر به معنای به‌کارگیری نظریۀ همکاری در نظام حقوقی نخواهد بود و نظام حقوقی ما دارای این نظریۀ نوین در آیین دادرسی نیست. پس از مطالعۀ موردی قانون آیین دادرسی مدنی فرانسه، اصول آیین دادرسی مدنی فراملی، و قوانین ایران، می‏توان گفت که نظریۀ همکاری، نظریه‌ای صحیح و مقبول است و می‌توان آن را در برخی باب‏ها ازجمله در تعیین صلاحیت محلی دادگاه، تعیین زمان جلسات، داوری، صلح و سازش، نحوۀ ابلاغ اوراق، شیوۀ ادارۀ جلسۀ دادرسی و غیره اعمال کرد.

چکیده English

The cooperation theory of the parties and the judge in the settlement of disputes is a new issue in the civil procedure that has been presented by one researcher in recent years. The cooperation theory is defined to mean law enforcement. In other wLLMords, the parties and the judge participate with each other to settle a dispute. Although in some of the new rules this theory can be seen sporadically, the principle of Transnational Civil Procedure Act (2004) provides the main foundation. By examining the laws of the country, it was found that although some materials of the principle of cooperation can be seen, this theory is not applied appliedin the legal system and our legal system is lacking the new principle. After studying French law, transnational civil procedure and Iranian law, we can say that the cooperation theory is correct and acceptable and can be applied in some cases including determination of local jurisdiction, set a date for trial, arbitration, peace and reconciliation, the way of delivering securities, the way of handling the hearing, etc.
