چکیده
برخلاف دیدگاه سنتی مبنی بر لزوم مداخلۀ دولت در شکل‌دهی و ایجاد ضوابط حقوقی، رویکرد‌های مبتنی بر جامعه‌شناسی حقوقی در دهه‌های اخیر مفاهیم و نظریاتی را مطرح نموده که مبنای آن لازم نبودن استفاده از ضمانت اجرای قانونی و نقش‌آفرینی دولت به شکل رسمی در عرصۀ حقوق است.
حقوق نرم از مهم‌ترین مفاهیم شکل‌گرفته بر اساس دیدگاه اخیر است که با توجه به معارضۀ آن با نظریات سنتی، چالش‌های نظری فراوانی را نیز ایجاد کرده و البته با پاسخ‌های متعددی از سوی پیروان حقوق نرم همراه بوده است. با اینکه در دنیای جدید نمی‌توان نقش و اهمیت حقوق نرم را نادیده گرفت، دربارۀ این موضوع چندان در ایران مطالعه نشده است. بر این‌ اساس، در این مقاله تلاش شده است افزون‌بر تحلیل ایرادهای مطرح‌شده پیرامون مبانی حقوق نرم و پاسخ‌های ارائه‌شده در مقابل آن‌ها، عناصر شکل‌گیری حقوق نرم، اصلی‌ترین علل رواج، و مزایای آن نسبت به حقوق سخت ارزیابی گردد.

چکیده English

While traditional points of law are based on centralism and formalism, in the last decades contrasting approaches emerged that deny the traditional role of government in law. “Soft Law” is one of the main concepts in this viewpoint that is completely controversial. Although soft law has evidently a great influence in practice, it is still a relatively unstudied topic in Iran.
This article is an attempt to consider the arguments of opponents and proponents of soft law, its core characteristics, benefits and instruments. The article argues that both of soft law and hard law should be used to make legal development.
