در آمدی بر مفهوم تنظیم گری حقوقی

چکیده

در کنار مکانیزم ها، شیوه ها و ابزارها و نهادهای کلاسیک مداخله حکومت و دولت در اداره امور عمومی از طریق قانونگذاری، اجرا و امر قضاء اشکال و ابزار دیگری ییش بین شده است. در این راستا، اشخاص حقوق عمومی خاص و مستقل از دولت (نهاد های تنظیم گر یا رگلاتورها) متصدی این امر مبتنی بر تحلیل اقتصادی بازار ( با غلبه رویکرد لیبرال و عدم مداخله و عدم ایجاد مانع در عمل) و سطح بندی اقتضایی و نزولی به صعودی در تنظیم گری و اولویت از عدم مداخله- اعتماد به نظم طبیعی و خود تنظیمی- ، مداخله نهادهای غیر دولتی، و تنها یس از این مرحله، در صورت عدم کفایت، وارد عمل می شوند. بر این اساس، دولت دیگر فعال مایشاء انحصاری در عرصه اداره امور عمومی نبوده؛ و حقوق سخت نیز تنها ابزار در تنظیم و ساماندهی روابط در حیات جمعی نیست،

Next to mechanisms, methods and instruments and classic public bodies to administer, there are new independent administrative and public authorities equipped with various skills and attribution, composed of soft law and hard law to regulate the public fields. The multiplicity of forms of regulation show the composite nature of regulation, which is between the private and public domain: laws, codes, charters, contracts, economic incentives and certification used in an increasing order of soft law in hard law. Now, the state is no longer the only player in the regulation of the game, but there are other private and public actors; what made change both the face and the content of the law and the state
