This right, which guarantees equal legal recognition between men and women, has a special proximity to women's rights to equality. Thus, although difference treatment in both of the international law and Islamic thought, does not necessarily violate equality. But, due to fundamental differences between international human rights and Islamic law. In the field of recognizing the equal rights between women and men, in practice is not similar function.Therefore, the present article seeks to examine the subject based on a descriptive and exploratory approach whit citing to the credible Islamic sources and interpretations, as well as international law documents and procedures. قرن‌هاست که زنان موضوع ظلم و تعدی‌های فراوان هستند و کمتر از یک قرن است که اندیشۀ دفاع از حقوق زنان در جامعۀ بین‌المللی ظهور یافته است. ازجمله حقوقی که تحول جدی را در عرصۀ حقوق زنان ایجاد کرده حق بر شناسایی حقوقی است که عقایدی را که زن را جنس درجۀ دوم تلقی می‌کردند، انکار می‌نمود. این حق که متضمن شناسایی حقوقی برابر زنان و مردان است، مقارنت ویژه‌ای با حق زنان بر برابری دارد. در این ‌میان، تمایز رفتاری در هر دو حوزۀ حقوق بین‌الملل و اندیشۀ اسلامی لزوماً ناقض برابری نیست، لکن به جهت اختلاف مبنایی میان حقوق بین‌الملل بشر و حقوق مدنظر اسلام، درعمل شاهد رویۀ یکسانی در خصوص شناسایی حقوق برابر زنان و مردان نیستیم. از این ‌رو، نگارندگان نوشتار حاضر سعی دارند بر اساس روشی اکتشافی- توصیفی و مستند به منابع و تفاسیر معتبر اسلامی و همچنین اسناد و رویه‌های حقوق بین‌المللی موضوع موردبحث را بررسی نمایند. https://jcl.ut.ac.ir/article_78980_db8d8e86a6b47b5afa33bf4929c35dd6.pdf
