The ICCPR and The Iran and Afghanistan Law’s are Recognized Liberty as a Principle throughout of the Criminal Proceedings. and Ruled to Deprive of Liberty is and Exception as the Last Resort by According Law Unless the Period of Time should be Appropriate Short and with Sufficient Guarantee. <br /> As Article 9 of the ICCPR permitted the Deprive Liberty of Suspect by Law. Human Rights Committee(HRC) are Required Member States to Obey the International Fair Trial Standards. The Afghan Legal System Considered; Suspect the Person who is in the Authority of Law Enforcement Officers and The Legla Conditions of Deprivetion Liberty In Afghanistan Criminal Procedure Code has been Limited to Important Evdent Crimes. <br /> But In Iran legal System that Person Considered Accused and Law Enforcement Officers have Authority to Deprived the Accused Librty in the Police Detintion Center for a Maximum of 24 Hours into Evident and non-Obvious Crimes, whether Impotant or not Important.While According to the International Fair Trial Standard, For minor Cases the Law Enforcement Officers may impose suitable Non-Custodial Measures, as Appropriate. آزادی شخصی یک حق مطلق و بدون قید و شرط نیست. میثاق و قوانین و مقررات ایران و افغانستان، آزادی را به‌عنوان یک اصل در طول فرایند دادرسی کیفری به‌رسمیت شناخته و سلب آن را به‌عنوان آخرین چاره در کوتاه‌ترین دورة زمانی مناسب همراه با تضمین‌های شکلی و ماهوی کافی طبق قانون، استثنا کرده و برشمرده‌اند؛ به‌طوری که مادۀ 9 میثاق، سلب آزادی فرد مظنون را طبق قانون مجاز دانسته است. کمیتۀ حقوق بشر هم دولت‌های عضو را به رعایت معیارهای دادرسی عادلانه مکلف کرده‌ است. قانون آیین دادرسی کیفری افغانستان فردی را که در اختیار مأموران ضبط قضایی قرار دارد، مظنون تلقی کرده و جهات تحت‌نظر را صرفاً در جرایم مشهودِ مهم احصا نموده است. ولی چنین فردی در حقوق ایران متهم تلقی شده، به ضابطان دادگستری این صلاحیت داده‌ شده است که آزادی افرادِ متهم را در جرایم مشهود و غیرمشهود اعم از اینکه مهم باشد یا کم‌اهمیت، برای مدت حداکثر 24 ساعت تحت‌نظر، سلب نمایند؛ درحالی که به‌موجب استاندارهای بین‌المللی دادرسی عادلانه، برای تخلفات کوچک ضابطان می‌توانند تدابیر غیربازداشتی مناسبی را اعمال کنند. https://jcl.ut.ac.ir/article_69834_a170192b3060dcf900b8e65a861a87b5.pdf
