The municipality of each city is the executive arm of these councils. In fact, the municipality implements the policies and decisions of the city council. However, there is always the concern that the municipality to be unable or unwilling to implement these policies. Therefore, the supervision of the city council over the mayor and the municipality is an important and fundamental issue and this study tries to answer this question: How does the city council supervise the municipality and what are the similarities and differences between the city council's supervision of municipalities in Iran and Canada? In response to this question, using descriptive and comparative method, it was concluded that although the government system of the two countries are fundamentally different; the former is a unitary states and the latter is a federal state, but in both countries the mayor is appointed as an executive director by the city council. Therefore, the city council monitors the proper performance of the municipality; a priori, during execution and posteriori. by appointing the mayor, setting policies and programs, appointing municipal officials, approving the budget and municipal transactions, monitoring revenue and expenditure accounts, supervising public services, settling of the budget.}, keywords = {City council,‎ Mayor,‎ Municipality,‎ local Government,‎ Oversight.‎}, title_fa = {چگونگی نظارت شورای شهر بر شهرداری در نظام حقوقی ایران و کانادا}, abstract_fa = {در کشورهایی که از عدم تمرکز محلی بهره می‌برند، شوراهای شهر به‌عنوان یک نهاد محلی برای پیشبرد سریع برنامه‌های اجتماعی، اقتصادی، عمرانی، بهداشتی، فرهنگی، آموزشی و سایر امور رفاهی از سوی مردم انتخاب می‌شوند. شهرداری بازوی اجرایی شورا و مجری سیاست‌ها و تصمیمات شورای شهر است، ولی این دغدغه همیشه وجود دارد که شهرداری نتواند یا نخواهد سیاست‌های مصوب را به‌اجرا درآورد. بنابراین، نظارت شورای شهر بر شهرداری یک امر مهم و اساسی است که این تحقیق سعی دارد به این سؤال پاسخ دهد که نظارت شورای شهر بر شهرداری در ایران به چه نحوی انجام می‌گیرد و چه تشابه و تفاوت‌هایی با کشور کانادا دارد. در پاسخ به این سؤال با روش توصیفی- تطبیقی ساختار دو کشور بررسی و ملاحظه گردید که هرچند در ساختار حکومت با هم تفاوت اساسی دارند و اولی یک کشور تک‌بافت (بسیط) و دومی کشور فدرال است، اما در کشورهای ایران و کانادا شهردار به‌عنوان یک مدیر اجرایی از سوی شورای شهر منصوب می‌‌شود. بنابراین، شورا با انتصاب شهردار، تعیین سیاست‌ها، برنامه‌ها، انتصاب مقامات شهرداری، تصویب بودجه، تأیید معاملات شهرداری، نظارت بر حساب درآمد و هزینه، نظارت بر حسن انجام خدمات عمومی، تفریغ بودجه و....، به سه صورت پیشینی، حین اجرا و پسینی بر شهرداری نظارت می‌نماید.}, keywords_fa = {شورای شهر,شهردار,شهرداری,عدم تمرکز محلی,نظارت.‏}, url = {https://jcl.ut.ac.ir/article_91244.html}, eprint = {https://jcl.ut.ac.ir/article_91244_ec2c4dc8bf900bd7f4277ea520c2c5c5.pdf} }
