Due to such economic significance, the place of such new comer economic phenomenon in international sales law documents is becoming much more colorful for legal discussion, Nevertheless, the debate over the 1980 Vienna Convention which deals only with goods, has not been updated. The main question of this paper is what components of the term 'goods' under the Vienna Convention of 1980 and what attitude can be considered in digital content. The paper has tried to show how the word 'goods' has been used in European directives. In this regard, some of these recently adopted directives, such as the (Directive-SGD-2019), have been slightly softened and they have somehow treated digital products as goods. By employing these documents, finally, the present work answers its main problematic question about the CISG. Given the preamble to the convention and general principles of it, such as its international character, it can be said that this convention has confirmed contemporary custom of international trade, not just a historical usage of the pre1980s. Therefore, noting the possibility of physical reception through Articles 30, 53 and 60 of the Convention, those all refer to the ability of physical possess, it seems that the word 'goods' in the Convention remains on its own literal meaning. And the outgoing perception from mentioned articles will be the status of physical possession at the time of delivery of goods, as a condition in most digital products.}, keywords = {Digital content,European parliament directives,Goods,Hague conventions,Vienna convention on international sale of goods 1980}, title_fa = {محصول دیجیتال به مثابه کالا در حقوق بیع بین‌الملل}, abstract_fa = {محصولات دیجیتالی در طول چند دهۀ اخیر موضوع معاملات تجاری بین‌المللی قرار گرفته‌‌‌‌اند. از‌‌ این رو، جایگاه محتوای دیجیتالی (Digital content) در اسناد بیع بین‌الملل نیز روز به روز پررنگ‌تر شده است. اما بحث در خصوص کنوانسیون وین ۱۹۸۰ که موضوع آن صرفاً کالا (Goods) بوده، به‌روز‌رسانی نشده است. پرسش اصلی این جستار آن است که واژۀ کالا در کنوانسیون وین ۱۹۸۰ چه عناصری دارد و با چه رویکردی می‌تواند شامل محتویات دیجیتالی شود. در این اثر نشان داده‌ایم که واژۀ کالا در دستور‌العمل‌های اروپایی چه سیری داشته است. بعضی از این دستور‌العمل‌ها که اخیراً به‌تصویب رسیده است مانند «Directive -SGD- 2019» کمی در این خصوص تلطیف شده‌اند و به‌نوعی محصولات دیجیتالی را کالاانگاری کرده‌اند. اثر حاضر با استخدام این اسناد درنهایت به پرسش اصلی خود در خصوص کنوانسیون ۱۹۸۰ وین پاسخ می‌دهد. با توجه به مقدمۀ این کنوانسیون و اصول کلی کنوانسیون مانند ویژگی بین‌المللی آن، می‌توان گفت این کنوانسیون سیره‌های معاصر تجارت بین‌المللی را امضا نموده است و نه صرفاً یک سیرۀ مرسوم در سال ۱۹۸۰ و ماقبل را. از این رو، با توجه به امکان قبض و اقباض فیزیکی در مواد ۳۰، ۵۳ و ۶۰ این کنوانسیون که تماماً اشاره به توانایی بر تصرف فیزیکی دارد، به‌نظر می‌رسد واژۀ کالا در کنوانسیون بیع بین‌الملل بر معنای لغوی و حقیقی خود باقی مانده‌ باشد، و نهایتِ برداشت از مواد یادشده، شرط تصرف فیزیکی هنگام تحویل کالا خواهد بود که در اغلب محصولات دیجیتالی این شرط وجود دارد.}, keywords_fa = {دستور‌العمل‌های اتحادیۀ اروپا,کالا,کنوانسیون بیع بین‌المللی کالا ۱۹۸۰ وین,کنوانسیون‌های لاهه,محتوای دیجیتالی}, url = {https://jcl.ut.ac.ir/article_84117.html}, eprint = {https://jcl.ut.ac.ir/article_84117_f86b69542c16cf8e3608d045e4cd2bf0.pdf} }
