In this regard, the adopters (or the single adopter) carry all responsibilities of the natural parents towards the child, and a parent-child-relationship will be created between them. Freedom of marriage is one of the fundamental principles of human rights. Nevertheless, today, the prohibition of consanguineous marriage is also a universal principle. In some societies, religions and various legal systems, there are, in respect of different kinship hierarchies, prohibited kinship degrees with whom a matrimonial relationship is forbidden. The “Law on the Protection of Children without a Guardian or with an Unworthy Guardian”, which was passed 2013, prohibits marriage between adopters adoptees during the custody period and thereafter, but allows it if the competent court finds out that the best interest of the child so requires. In the absence of an Islamic legal prohibition, there have been cases of marriage with an adoptee. This kind of marriage is now, at least, dependent on court’s permission based on the best interests of the child. On the other hand, it is forbidden for adopters to marry the adoptee in England and Germany, two countries whose laws are going to be analyzed in this study. In this regard, this article seeks to explain the legal status of three countries, i.e. Iran, England, and Germany, with a focus on the principle of the best interest of the child and the freedom of marriage. Although the conditional ban on marriage in Iran's legal system and its prohibition in two other countries indicate a common concern of the Iranian legislature with the above mentioned countries, it seems that the principle of freedom of marriage continues to be of particular importance and, therefore, has its impact on this ban.}, keywords = {The best interest of the child,freedom of marriage,forbidden marriage,marriage with the adoptee,child abuse}, title_fa = {مطالعۀ تطبیقی قوانین ایران، انگلستان و آلمان دربارۀ ازدواج با فرزندخوانده}, abstract_fa = {فرزندخواندگی نهادی حقوقی ‌است که به‌موجب آن یک کودک محروم از خانواده، تحت سرپرستی و حمایت‌های یک خانواده قرار می‌گیرد و به این ترتیب، والدین فرزندپذیر کلیۀ مسئولیت‌های والدین طبیعی نسبت به فرزند را عهده‌دار می‌شوند و رابطۀ والد فرزندی بین این افراد شکل می‌گیرد. اصل آزادی نکاح نیز یکی از اصول مسلم حقوق بشری است. امروزه اصل ممنوعیت ازدواج با محارم یک اصل جهانی است. در جوامع، ادیان و نظام‌های حقوقی مختلف و در سلسلۀ روابط خویشاوندی و خانوادگی طبقاتی وجود دارند که ایجاد پیوند زناشویی بین آنان ممنوع است. در ایران با تصویب قانون حمایت از کودکان و نوجوانان بدسرپرست و بی‌سرپرست مصوب 1392ش و ممنوع کردن ازدواج با فرزندخوانده در زمان حضانت و پس از آن، چنین ازدواجی به تشخیص مصلحت فرزندخوانده از سوی دادگاه صالح مشروط شد، به این دلیل که با عدم ممنوعیت شرعی و سکوت قانون، مواردی از ازدواج با فرزندخوانده وجود داشته است که لااقل با این مقرره انجام چنین ازدواج‌هایی موکول به اجازۀ دادگاه مبتنی بر مصلحت فرزندخوانده خواهد شد و به این ترتیب، از فرزندخوانده در برابر آسیب‌های احتمالی حمایت می‌شود.  این درحالی است که ازدواج با فرزند خوانده در دو کشور دیگر مورد مطالعه، یعنی انگلیس و آلمان، ممنوع است که با مطالعۀ قوانین آن، وضعیت نظام حقوقی این سه کشور با محوریت اصل مصالح عالیۀ کودک و اصل آزادی نکاح تبیین خواهد شد. اگرچه ممنوعیت مشروط این ازدواج در نظام حقوقی ایران و ممنوعیت آن در دو کشور دیگر نشان از دغدغۀ مشترک قانون‌گذار ایران با کشورهای پیش‌گفته دارد، لیکن ظاهراً اصل آزادی نکاح همچنان دارای اهمیت ویژه‌ای بوده و این ممنوعیت را تحت‌الشعاع قرار داده است.}, keywords_fa = {ازدواج با فرزندخوانده,ازدواج‌های ممنوعه,اصل آزادی نکاح,حقوق خانوادۀ تطبیقی,کودک‏آزاری,مصالح عالیۀ کودک}, url = {https://jcl.ut.ac.ir/article_78994.html}, eprint = {https://jcl.ut.ac.ir/article_78994_a6e0c00d872e0cc2636f87da28450d92.pdf} }
