It is examined in detail that, beyond decolonization, the right to self-determination does not include a general right to external self-determination. In non-colonial situations, there are two theories of unilateral secession and remedial secession. By examining the Crimea case in the light of each the cases, we conclude that unilateral secession is generally permitted under international law, but the unilateral secession of Crimea from Ukraine is an exception and prohibited under international law. Because it is the result os Russian military intervention in the peninsula and a sort of widespread violation of international law. On the other hand, by examining the practices of gevernments and judicial and semi-judicial bodies, we find that remedial secession is not yet a part of customary international law and the doctrine is also cntroversial. Assuming Crimea cannot be cinsidered a viable secession due to the diversity of the peninsula population and lack of “people” and lack of evidence of human rights violations or organized discriminatory behavior by Ukrainian authorities.}, keywords = {Crimea,remedial secession,Russia,Territorial integrity,unilateral secession}, title_fa = {نگرشی انتقادی به مسئلۀ جدایی کریمه از اوکراین در حقوق بین‌الملل}, abstract_fa = {نوشتار حاضر با بررسی مشروعیت جدایی یک‌جانبۀ کریمه از اوکراین طبق حقوق بین‌الملل عمومی، در پی پاسخ به این پرسش است که آیا آن‌گونه که مقامات کریمه و روسیه استدلال می‌کنند، حق تعیین سرنوشت می‌تواند مبنای حقوقی جدایی کریمه از اوکراین قرار بگیرد. به تفصیل بررسی می‌شود که خارج از بحث استعمارزدایی، حق تعیین سرنوشت شامل هیچ‌گونه حق کلی بر تعیین سرنوشت خارجی نمی‌شود. در ‌مورد موقعیت‌های غیراستعماری نیز دو نظریۀ جدایی یک‌جانبه و جدایی چاره‌ساز مطرح می‌شود. با بررسی موضوع کریمه در سایۀ هریک از این موارد به این نتیجه می‌رسیم که جدایی یک‌جانبه اگرچه به‌طور کلی طبق حقوق بین‌الملل مجاز است، اما جدایی یک‌جانبۀ کریمه از اوکراین از این قاعده مستثناست؛ چراکه نتیجۀ مداخلۀ نظامی غیرقانونی روسیه در شبه‌جزیره و نوعی نقض گستردۀ قاعدۀ حقوق بین‌الملل عمومی محسوب می‌شود. از دیگر سو، با بررسی رویۀ دولت‌ها و نهادهای قضایی و نیمه‌قضایی، درمی‌یابیم که جدایی چاره‌ساز هنوز بخشی از حقوق بین‌الملل عرفی نشده و دکترین نیز در‌ مورد آن دچار اختلاف ‌نظر است. ضمن آنکه در فرض قبول آن، نمی‌توان کل شبه‌جزیره را به دلیل تنوع جمعیتی، یک «ملت» دانست. افزون بر آن، به دلیل فقدان مستنداتی که حاکی از نقض حقوق بشر یا رفتار تبعیض‌آمیز سازمان‌یافته از سوی مقامات اوکراینی است، نمی‌توان مسئلۀ کریمه را مصداق جدایی چاره‌ساز دانست.}, keywords_fa = {تمامیت سرزمینی,جدایی چاره‌ساز,جدایی یک‌جانبه,روسیه,کریمه}, url = {https://jcl.ut.ac.ir/article_78988.html}, eprint = {https://jcl.ut.ac.ir/article_78988_12a519bbe488c031e9cf2617b36ca9d6.pdf} }
